Robert v. Bolinske filed a complaint in district court, seeking to permanently enjoin the North Dakota State Fair Association (the Association) from interfering with his right to freely circulate initiative petitions at the North Dakota State Fair. The court granted the Associations motion for a summary judgment, dismissing Bolinskes complaint on its merits, and Bolinske appealed. We affirm, holding that the Associations regulations do not violate Bolinskes right of free speech under the First and Fourteenth Amendments of the United States Constitution or his right to propose laws by the initiative process under Article III, Section 1, of the North Dakota Constitution.
